Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes activities you must not perform on or through the Koda Properties Service. It is part of our Terms of Service.
1. Prohibited use
You must not (and must not allow anyone else to):
1.1 Unlawful conduct
- Violate any applicable law, regulation, or third-party rights.
- Process data in ways that violate privacy or data-protection laws.
- Use the Service to harass, threaten, defame, or discriminate.
- Promote or facilitate violence, terrorism, child sexual abuse material, or human trafficking.
1.2 Security violations
- Attempt to access accounts, data, or resources you are not authorized to access.
- Probe, scan, or test vulnerability of the Service except as permitted by our Security Policy.
- Bypass or disable security or authentication features.
- Introduce malware, viruses, worms, or other harmful code.
- Forge headers, impersonate any person or organization, or misrepresent affiliation.
1.3 Abuse of the Service
- Send unsolicited bulk email or spam through Service-provided communication features.
- Use the Service to send phishing, scam, fraudulent, or deceptive content.
- Use automated means to generate excessive load, scrape data, or evade rate limits.
- Resell, sublicense, or commercially exploit access in ways not permitted by your subscription.
- Use the Service to build a competing product or service.
1.3.1 Commercial electronic messages — CASL
When you use the Service to send commercial electronic messages to Canadian recipients, you are responsible for complying with Canada's Anti-Spam Legislation (CASL). You must:
- Have express or implied consent from each recipient before sending.
- Include accurate sender identification.
- Provide a working unsubscribe mechanism that takes effect within 10 business days.
- Maintain records of consent.
You must not use the Service to send commercial electronic messages that violate CASL or comparable anti-spam laws (e.g. Jamaica's Cybercrimes Act 2015, U.S. CAN-SPAM, EU PECR).
1.4 Content restrictions
- Upload content that infringes intellectual property, trade secrets, or rights of publicity.
- Upload content containing malware or executable code intended to harm other users.
- Upload content that violates the privacy of identifiable individuals without authorization.
- Upload sexually explicit content or content depicting violence except where lawful and contextually appropriate (e.g. evidence in a violation record).
1.5 Account & identity
- Share account credentials. Each individual user should have their own account.
- Maintain inactive accounts solely to circumvent licensing limits.
- Permit minors under 16 to use the Service without parental supervision.
2. Reporting violations
If you become aware of any violation of this AUP, please report it to abuse@koda.properties. Include enough detail (URLs, account names, timestamps) for us to investigate.
3. Enforcement
We may investigate violations and take action including:
- Removing offending content.
- Suspending or terminating the offending account.
- Notifying law enforcement or other authorities if required by law.
- Pursuing legal remedies, including recovery of damages.
We may act immediately and without notice in cases of urgent security risk, ongoing harm to others, or legal compulsion.
4. Changes
We may update this AUP. Continued use of the Service after the effective date of a revised AUP constitutes acceptance.
