Subscription & Refund Policy

This policy governs subscriptions to and refunds for the Koda Properties Service. It supplements our Terms of Service.
1. Billing cycles
- Monthly subscriptions are billed each month on the anniversary of your signup.
- Annual subscriptions are billed once for a full 12-month term, charged at signup and at each renewal.
- All fees are charged in advance.
2. Auto-renewal
Subscriptions renew automatically at the end of each term unless you cancel before the renewal date. We will email a reminder before annual renewals.
3. Free trial
Where we offer a free trial:
- No payment is required during the trial period.
- You may cancel at any time during the trial with no charge.
- If you do not cancel before the trial ends, your subscription begins and your stored payment method is charged for the chosen plan.
4. How to cancel
You can cancel at any time from your account settings (Account → Subscription → Cancel) or by emailing billing@koda.properties. Cancellation takes effect at the end of your current billing term — you keep access until then. We do not pro-rate refunds for unused time on a current term except as described in section 5.
5. Refund eligibility
We offer refunds in the following cases:
- 14-day cooling-off period for first-time subscribers. If you subscribe to a paid plan for the first time and request a refund within 14 days of the initial charge, we will refund 100% of the amount paid. This does not apply to renewals or to subsequent subscriptions after cancellation.
- Material Service failure. If we materially breach our Service warranty in the Terms of Service and fail to remedy within a reasonable period, you may request a pro-rated refund of unused prepaid fees.
- Erroneous duplicate charges. Refunded in full.
The following are not eligible for refund:
- Monthly subscription fees that have already been billed.
- Annual subscription fees after the 14-day window, except as noted above.
- Fees for setup, customization, or one-time services already performed.
- Amounts paid more than 90 days before the refund request.
- Charges related to suspension or termination for breach of the Terms or AUP.
6. How to request a refund
Email billing@koda.properties from the email address associated with the account. Include the account name and the charge you are disputing. We will respond within 5 business days. Approved refunds are typically returned to the original payment method within 5–10 business days, depending on your bank.
7. Pricing changes
We may change pricing for renewal terms with at least 30 days' notice. The new price applies starting from your next renewal. You may cancel before the renewal if you do not accept the new price.
8. Taxes
Fees do not include taxes (sales tax, VAT, GST, etc.) unless explicitly stated. You are responsible for taxes other than taxes on our income.
9. Failed payments
If a charge fails:
- We will retry the charge several times over the next few days.
- We will email you about the failed payment.
- If the payment remains unpaid after 14 days, we may suspend access until the balance is resolved.
- If unpaid after 30 days, we may terminate the subscription.
10. Chargebacks
If you have a billing issue, please contact us first. Initiating a chargeback before contacting us may result in your account being suspended pending review.
11. Statutory consumer rights
Nothing in this policy limits or replaces rights you may have under applicable consumer protection law:
- Canada: the federal Consumer Packaging and Labelling Act and provincial Consumer Protection Acts (notably Ontario's Consumer Protection Act, 2002, Quebec's Consumer Protection Act CQLR c. P-40.1, BC's Business Practices and Consumer Protection Act, and equivalents elsewhere) grant you statutory rights — including, for distance contracts in some provinces, a right to cancel and obtain a refund within set time windows.
- Quebec: if you are a consumer in Quebec, the Consumer Protection Act and Civil Code of Québec protections take precedence over inconsistent terms in this policy.
- Jamaica: the Consumer Protection Act 2005, the Sale of Goods Act, and the Electronic Transactions Act 2006 grant statutory rights that we will honor in full.
If a clause in this policy conflicts with a non-waivable statutory right that applies to you, the statutory right prevails.
